End User License Agreement

Subject to your compliance with this Agreement, The Fitness Flow grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the The Fitness Flow application on your compatible Apple devices for your personal, non-commercial use.

This license becomes effective upon your download or first use of the application and continues until terminated in accordance with the terms herein.

Your license to use The Fitness Flow includes the following permitted uses:

The license is personal to you and may not be transferred, assigned, or sublicensed to any third party.

You are expressly prohibited from the following activities:

Technical Restrictions:

• Reverse engineering, decompiling, disassembling, or attempting to derive source code
• Modifying, adapting, altering, or creating derivative works
• Removing, altering, or obscuring any copyright notices or proprietary markings
• Circumventing or disabling any security features or access controls

Distribution Restrictions:

• Redistributing, selling, renting, leasing, or sublicensing the application
• Making the application available on networks or for use by multiple users
• Creating any alternate methods to download or access the application

Commercial Restrictions:

• Using the application for commercial fitness training or coaching without permission
• Extracting data for commercial database creation or competitive products
• Using the The Fitness Flow name, logo, or branding in commercial ventures

The Fitness Flow and all its components are protected by intellectual property laws:

Our Rights:

• All source code, algorithms, and application logic
• User interface designs, graphics, and visual elements
• The Fitness Flow name, logo, and branding materials
• Documentation, help files, and instructional content

Your Rights:

• Ownership of your personal workout data and content you create
• Right to export and delete your data at any time
• Privacy rights as outlined in our Privacy Policy

Your privacy is important to us. This section outlines key data practices:

Data We Collect:

• Workout schedules, exercise data, and session logs you create
• App usage information for performance optimization

Data We Don't Collect:

• Personal identification information (name, email, phone)
• Location data or GPS tracking
• Health data beyond what you manually enter
• Analytics or advertising tracking data

The Fitness Flow integrates with the following third-party services:

Apple Services:

• App Store: Application distribution and updates
• iOS Platform: Core operating system functionality

Your use of these services is subject to Apple's Terms of Service and Privacy Policy. We are not responsible for any third-party service terms, availability, or privacy practices.

No Warranties:

• We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement
• We do not warrant that the app will be error-free, uninterrupted, or secure
• We do not guarantee compatibility with all devices or iOS versions
• We do not warrant the accuracy of any fitness calculations or recommendations

Fitness and Health Disclaimer:

• The Fitness Flow is a fitness tracking tool, not medical advice
• Consult healthcare professionals before starting any exercise program
• Use the app at your own risk and within your physical capabilities
• We are not responsible for injuries or health issues related to your workouts

To the maximum extent permitted by law:

Excluded Damages:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• This includes damages for loss of profits, data, use, goodwill, or other intangible losses
• Liability exclusions apply regardless of the theory of liability (contract, tort, negligence, etc.)

Maximum Liability:

• Our total liability shall not exceed the amount you paid for the app (if any)
• For free applications, liability is limited to $1.00
• These limitations apply even if remedies fail their essential purpose

You agree to indemnify, defend, and hold harmless The Fitness Flow and its affiliates from any claims, damages, losses, or expenses arising from:

• Your use or misuse of the application
• Your violation of this Agreement or applicable laws
• Your violation of any third-party rights
• Any content or data you input into the application
• Any fitness activities or workouts performed using the app

This indemnification obligation survives termination of this Agreement.

This Agreement and your license to use The Fitness Flow may be terminated:

Termination by You:

• Delete the application from all your devices
• Discontinue all use of the application
• No refund obligations for paid applications

Termination by Us:

• Immediately if you breach any terms of this Agreement
• With notice for convenience or business reasons
• Automatically if the app is removed from the App Store

Effects of Termination:

• Your license to use the app immediately terminates
• You must cease all use and delete the app from your devices
• Provisions regarding liability, indemnification, and governing law survive termination

The Fitness Flow may be updated or modified to improve functionality, security, or compliance:

App Updates:

• Updates may be delivered through the App Store
• Some updates may be required for continued functionality
• New features may be added or existing features modified
• Updates do not extend any warranty periods

Agreement Modifications:

• We may modify this Agreement at any time
• Significant changes will be communicated through the app or email
• Continued use after changes constitutes acceptance
• If you disagree with changes, you may terminate your license

This Agreement and any disputes arising from it shall be governed by:

If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
